Effective September 8, 2026. These terms govern your use of the Adjuster Check mobile app, website and client portal (the "Services"), operated by Adjuster Check LLC ("Adjuster Check", "we", "us"). By creating an account, accepting the terms in the app, or using the Services, you agree to them. If you do not agree, do not use the Services.Vigentes desde el 8 de septiembre de 2026. 1. What the Services are, and what they are not1. Qué son los Servicios, y qué no son
Adjuster Check is a documentation and estimating-support tool for roofing and restoration contractors. It reads insurance claim estimates, compares them against a catalog of commonly required work, and helps you prepare counter (supplement) documents. The Services are software tools only. Adjuster Check is NOT an insurance company, public adjuster, appraiser, engineer, or law firm, and nothing in the Services is insurance advice, public adjusting, legal advice, or a professional opinion about any specific claim, property, or building code requirement.Adjuster Check es una herramienta de documentación y apoyo a estimados para contratistas de techado y restauración. Every document the Services help you produce is prepared under your direction and sent by you, in your name and your company's name. Before sending anything to an insurance company, you must review it and confirm that every line item, quantity, price, measurement, address, and statement is accurate and truthful for the specific property and claim. You, not Adjuster Check, are responsible for: (a) the accuracy and completeness of every counter, supplement, photo, and note you submit; (b) holding any license, registration, or insurance your work and your jurisdiction require; (c) complying with all laws that apply to your business, including laws on insurance fraud, contractor conduct, and public adjusting; and (d) your agreements with your customers.Cada documento que los Servicios le ayudan a producir se prepara bajo su dirección y lo envía usted, a su nombre y el de su empresa. 3. Job-site safety and assumption of risk3. Seguridad en el sitio de trabajo y asunción de riesgo
Roofing work and roof inspections are inherently dangerous and can result in serious injury or death, including from falls, structural failure, weather, electricity, and equipment. The Services are software only: nothing in the Services requires, directs, or supervises any physical activity, and any suggestion to photograph, measure, or document a roof or property is satisfied however YOU choose, including from the ground, from a ladder at a safe height, with a drone, with existing photos, or by declining. You are a professional contractor and you alone decide whether, when, and how anyone accesses a roof or job site. You are solely responsible for job-site safety, for using proper fall protection and safety equipment, for complying with OSHA and all other applicable safety laws and standards, and for the training, supervision, and safety of your employees, subcontractors, and anyone else on site. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISK OF PHYSICAL ACTIVITY UNDERTAKEN IN CONNECTION WITH THE SERVICES, AND ADJUSTER CHECK WILL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM ROOF ACCESS, INSPECTIONS, PHOTOGRAPHY, MEASUREMENTS, REPAIRS, OR ANY OTHER PHYSICAL ACTIVITY, WHETHER OR NOT RELATED TO CONTENT SHOWN IN THE SERVICES.El trabajo de techado y las inspecciones de techos son inherentemente peligrosos y pueden causar lesiones graves o la muerte, incluidas caídas, fallas estructurales, clima, electricidad y equipos. Insurance outcomes are decided by insurance companies, not by us. We do not promise that any counter will be accepted, that any amount will be recovered, or that using the Services will increase any payout. Automated document reading can misread, miss, or misclassify items; catalogs, prices, quantities, measurements, climate-zone guidance, and building-code references in the Services are general aids based on nationwide data and public sources, may be wrong for your project, and are not quotes or promises of recoverable value. "Expected value", "potential gain", "we found $X" and similar figures are estimates only. We are not responsible for items the Services miss, for items the Services include that an insurer rejects, or for any decision you make in reliance on the Services.Los resultados de los seguros los deciden las aseguradoras, no nosotros. You must provide accurate account information and keep your sign-in method secure; you are responsible for activity under your account. The Services are for business use by contractors and their staff, by users 18 or older. You can delete your account at any time in Settings or at adjustercheck.com/delete-account.html.Debe proporcionar información de cuenta exacta y mantener seguro su método de acceso; usted es responsable de la actividad en su cuenta. Reading a claim document is free. Opening a claim's full counter uses one claim credit. Credits are sold in packs through the Apple App Store or Google Play, never expire, and are consumed when you open a claim. Store purchases are processed by Apple or Google under their terms; prices shown in the store are final. Except where required by law or expressly offered in the app (for example a result-dispute credit under Section 7), credits and purchases are non-refundable and have no cash value. 7. Result-dispute credits7. Créditos por disputa de resultado
If a claim you opened with a credit recovers less than the price you paid for that credit, you may ask us to review it and return the credit. To review a dispute we need evidence: at minimum the counter document that was actually sent to the insurance company and the insurer's written response. We decide disputes in good faith at our reasonable discretion; a returned credit is a credit to your Adjuster Check balance, not a cash refund. Disputes must be raised within 90 days of opening the claim.Si un reclamo que abrió con un crédito recupera menos de lo que pagó por ese crédito, puede pedirnos revisarlo y devolver el crédito. You keep ownership of the documents, photos, and data you upload. You grant us the license needed to operate the Services: to store, process, analyze, and display that content to you and to the people you share it with (for example through the client portal). You confirm you have the right to upload what you upload, including your customers' claim documents and personal information, and that you have given your customers any notice their law requires. Our handling of personal information is described in the Privacy Policy. AI processing is inference-only; we do not use your claim documents to train models.Usted conserva la propiedad de los documentos, fotos y datos que sube. Do not use the Services to submit false, inflated, or misleading information to anyone; to violate any law; to infringe others' rights; to probe, overload, or reverse-engineer the Services; to resell or scrape them; or to upload malicious code. TO THE FULLEST EXTENT PERMITTED BY LAW: (A) ADJUSTER CHECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST CLAIMS VALUE, OR LOSS OF DATA OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THAT PERIOD. We may change or discontinue features, and may update these terms; material changes will be announced in the app or by email, and continued use after the effective date is acceptance. You may stop using the Services at any time; unused credits on a deleted account are forfeited except where law requires otherwise. These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Courts located in Travis County, Texas have exclusive jurisdiction, and each party waives objections to that venue.
